Collaborative divorce is a family law procedure that ends in a traditional divorce, but, rather than battle it out in court, the parties agree to treat each other with respect and work toward the common goal of the divorce.
Collaborative divorces work because the parties enter into a participation agreement that outlines how they will treat each other during the divorce process:
- The lawyers cannot litigate the case. If the case fails to resolve itself collaboratively, the parties must find new lawyers. This check keeps everyone working toward a real resolution.
- Neither party will take advantage of the mistakes of the other party.
- The parties will disclose all relevant information. The parties will not hide any material facts.
- Everything that is said in meetings is confidential.
- Any expert witnesses are neutral and both parties hire them together.
- Everyone will act with courtesy and in good faith.
